Agreement of Legal Terms Of Use
If you access and use this Internet website or any URL linking to our Financial articles or content, you accept and agree to be bound by and comply with the following terms. All payments shall be in reference to pricing set forth currently as stated on your invoices issued by Canadian Financial Publishing Group (also referred to as CFPG herein) unless otherwise agreed to in writing signed by CFPG. All terms of use set forth herein apply to all parties including representatives or owners of mutual fund dealerships unless alternative pricing has been contracted. If you do not accept the terms and conditions of this Agreement of Legal Terms of Use, do not begin to use or access any of the links or URLs of these Internet services. All parties entering any website with this legal notice attending, are strongly advised to read the Copyright Information below. If you do not read it, you will remain liable for any copyright infringement. This agreement is a contract if you use CFPG services and is periodically updated to cover our potential liabilities and if updated will apply to all clients and prospects and anyone else who reads the text herein.
Regarding Payment by Contractees for Access to Services
If you are a Financial representative or advisor or consultant or mutual sales person or any other party agreeing to pay for and access CFPG’s copyright data content for a website and have not yet paid for the subscription of the service you will access, do not use or access any of the links or URLs of these Internet services. Payment for these Internet services rendered must be made within at least 15 days of the receipt of an invoice or you may be in defiance of the legal agreement of use set forth herein, including but not limited to copyright infringement, and your service may be halted until such payment or any other payment for an outstanding CFPG invoice is made and such payments shall remain due. Payments are normally invoiced for pre-payment in cycles of up to one year in advance of service or on quarterly basis, or a preauthorized monthly basis that can be requested. All unpaid invoices remaining in arrears after 90 days may be forwarded to a collection agency. Canadian Financial Publishing Group reserves the right to add or increase fees or alter the terms of agreement at any time after one year of service has been rendered, to reflect increased costs of Internet business.
Use Of Website Services
Canadian Financial Publishing Group is not responsible for any reason for direct, indirect, special or consequential damages, however caused, arising out of your use of this Internet service and/or any web browser, or email service offered by CFPG, or any damages you may suffer if you transmit confidential or sensitive information to us or if we communicate such information to you at your request over the Internet, or where service is interrupted for any length of time. Links to other websites from CFPG Internet websites or URLs are for convenience only. No endorsement of any third party products, services or information is expressed or implied by any information, material or content referred to or included on, or linked from or to this website.
Hosting Your Website
Canadian Financial Publishing Group websites cannot be transferred to another ISP for hosting purposes, as the construction and configurations are designed to link to Canadian Financial Publishing Group copyright data. However, another ISP can point your domain name to your website's location at Canadian Financial Publishing Group where that ISP manages and charges for your domain's registration fees, but Canadian Financial Publishing Group does the actual hosting in all cases regarding the Internet website which also accesses CFPG Internet copyright data. Canadian Financial Publishing Group is competitive regarding registration and renewal fees of domains and suggests that you compare pricing, or request a price review before choosing any non-Canadian Financial Publishing Group registrar or ISP, which ultimately may serve no purpose to enhance your website service. Due to the technical nature of the service, Canadian Financial Publishing Group is not responsible for any down-time experienced when a website service is not functional for any reason or for any length of time. CFPG hosting is also competitive when compared to other hosting services hosting a large business website structure such as your website (your site can be as large as 300 meg with CFPG data links).
Your Files Built by CFPG Only to be Linked to CFPG Sites
Files built by CFPG for your website hosted on CFPG hard drives cannot be copied and reused elsewhere with another ISP or domain host service. The reason is this: CFPG builds websites at a bare minimum fee, and amortizes that build forward, respective to the income CFPG will receive from the sale of their data. Thus, CFPG would take a loss, if another ISP offered to host files built by CFPG, after a website is built with the intent of not using our data services into the future. Where the data services will not be used and paid for, CFPG views this as a conflict of interest, to release files built specific to any website personalization.
To acquire these files by any means such as copies and to re-link them to any future site not managed by CFPG will be classified as a violation. You will need to work from your original files such as your Word documents sent.
Where CFPG has refurbished any website, the above still holds true; a client that is canceling for any reason, where the intention is to not use CFPG data, must in this case refer back to their own original unposted data. All links to CFPG sites are the property of CFPG as far as use goes; as is all work or design on CFPG sites on behalf of clients, despite cancellation or the subsequent destruction of those files.
To advise any Canadian Financial Publishing Group client or prospect that it is possible to copy and reuse files any where else, may open an ISP or web technician to litigation for setting forth erroneous information about a Canadian Financial Publishing Group policy or about the potential of moving a Canadian Financial Publishing Group site, when that is in actuality impossible according to our disclaimer herein.
Changes and Edits to Your Website
Only Canadian Financial Publishing Group is allowed to make any alteration to your website, regarding uploading of any change, edit or update. Any other ISP or web technician is not allowed to access or upload to your website at any time as Canadian Financial Publishing Group websites are located on hard-drives where highly confidential and copyright information resides. Due to the technical nature of the service, Canadian Financial Publishing Group is not responsible for any problem or loss of data transmission or business income, or any business or personal liability that could be caused when transferring email messages with or without file attachments, or losses or liabilities in relation to any associated email service that you may use in your business, or any down-time experienced when the email service is not functional for any reason or for any length of time, or where unwanted email or viruses are received by anyone.
Website Design
Canadian Financial Publishing Group is not responsible for the functionality or continuity of certain elements installed that have been designed by non-Canadian Financial Publishing Group Inc, designers or webmasters. In all cases Canadian Financial Publishing Group should be consulted by any designer or webmaster who would create any element to be implanted into a website built and maintained by Canadian Financial Publishing Group Where non-Canadian Financial Publishing Group design or html work is requested to be installed, there will be fees associated with configuration and the time to do such installation and uploading. Such work where other parties are preparing design or html pages, may increase the time beyond CFPG’s normal design and installation procedures and concomitantly, CFPG’s docket time if CFPG were to do such work alone.
Where update design fees are not paid, it shall be viewed that your account is in arrears, and your site may be shut down.
Sale Of Products And Services Information
Canadian Financial Publishing Group does not sell any products or content or services other than documented information provided by CFPG and set forth on this website. CFPG is not responsible for any use of this website by anyone in or outside of the Financial industry who may or may not sell Financial products or advise regarding Financial planning or tax planning beyond their licensed or certified authority in any jurisdiction. Where any erroneous application of any information on CFPG's website occurs, it shall not be deemed the responsibility of CFPG. CFPG is not responsible for any representative’s, mutual fund dealership's, mutual fund company's, life insurance company's, or any other party's interpretation of any compliance or content issue or updating issue or where any other corporation's or individual's or your own judgment or bias of the site ensues or if for any reason a mutual fund dealership or any other party requests your website to be reworked or access to your Internet site or data link be shut down for any period of time; and any payments due to CFPG shall remain due even where a provincial or a national legislative body changes legislation, or where an assessment by any such legislative body shall necessitate a request to CFPG to change certain elements of any website structure or shall effect the use of any of CFPG's websites by the contractee (even though CFPG seeks to comply within a reasonable period of time). CFPG seeks to meet all MFDA standards and to keep articles updated and will communicate with any compliance officer with good intentions and suggestions for improvement. CFPG will remain open to addition or removal or updating or editing of certain portions of text upon request. CFPG is not responsible for corrections or changes or additions or updates or editing requested by compliance officers or the representative if they are not proofed by the contractee and further directives issued to CFPG for correction.
Regarding Co-op Funding For Websites
Though CFPG offers Internet data more specific to the mutual fund industry, it does not take responsibility for any interpretation by any party that deems to pay or not pay for some portion of funding for these Internet websites. Payment by any party subscribing to CFPG's Internet services shall remain due irrespective of said interpretation. We would like to differentiate the following: It is suggested that you do not co-op the website services, but we will seek to keep the services compliant.
Internet Website Interruptions
Where there is a technical difficulty or interruption of any CFPG service for any period of time, CFPG will seek to rectify the problem, yet such interruption shall not nullify this contract or any payment for any CFPG service due. Where a website or email service is noted as being non-functional for a significant period of time we ask that you first check your website’s connectivity through your Internet High Speed telephone or Cable service, or dial up line service, whichever is applicable (these are other non-CFPG services that can directly effect functionality). We want to note that CFPG-specific non-functionality is very rare.
Financial Viewpoint Access to CFPG Data URLs
By virtue of initial use or down payment, all parties leasing CFPG data for their own website agree to all statements regarding copyright use in this Legal Agreement and shall be liable for payments of invoices issued upon receipt.
Proofing A Change
When any change to a website is requested by any party with reference to your website, it is the responsibility of the contractee to examine and reexamine the requested change on the website until satisfied and CFPG should be notified until such change is satisfactory. Where a newsletter change has been submitted, CFPG will not necessarily update the website until notified with a specific website directive.
Other

Contractee Responsible for Website Promotion - Not CFPG
Initiating an agreement to pay for and access services rendered by Canadian Financial Publishing Group does not imply that Canadian Financial Publishing Group is responsible for or guarantees that anyone browsing the Internet will visit your site through any search engine or by entering your URL in their browser. All promotion and advertising of anyone or any company leasing access to a website designed by, or services rendered by, Canadian Financial Publishing Group is the responsibility of the contractee as contracted automatically herein. The contractee's promotion of their site location is their own responsibility and will not set forth any argument for discounting or annulment of payments due, past, present, or future.
Contract Period & Cancellation Policy
The minimum period of initial Internet access to CFPG’s copyright data shall be automatically contracted for one year without a formal contract, or two or more years by formal contract, from the first date of copyright Internet access to any service as indicated on the initial set-up invoice, and will automatically renew each following period for another new contract period of the same duration irrespective of payment periods or invoicing cycles that are less than one year.
After the initial contract period, to terminate a website or any copyright access to CFPG Internet data, a registered letter must be received 90 days in advance of the time of such termination. In all cases all outstanding fees not yet paid, relating to data, hosting, changes, edits, and domain registrations shall be due, including up to the date of requested termination, even where the Internet service has been shut off as per a directive from the client, or for non-payment. Where a dispute arises, CFPG shall determine the actual initial anniversary date, as the first day of the first copyright Internet access period as stated on CFPG invoice records and the remaining amount due. To seek to circumvent payment of any invoice, or remaining fees due at termination for any reason, not in accord with this agreement, will be deemed an infringement of copyright and prosecuted by law. Termination letters will not be deemed legal if given verbally over the phone or by facsimile or by email, without utilizing a distinct registered mail or courier service that offers a registered receipt as proof of receipt. Nor will past due invoices or monies owed be overlooked where data links are removed from websites for the purpose of evading payment; and it should be seriously noted, that without receipt of a registered letter of cancellation as proof of cancellation, a client will have no legal recourse if payment is overlooked for any reason.
Continuance of Service after Contract
Even where the initial period of copyright Internet access has renewed, or continued past the initial contract period in order to retain pricing, or service, or due to non-cancellation, fees will be deemed due, until either a new contract is formalized or a cancellation is requested and completed as per the above stated method using a registered letter by mail or courier.
Prepayment
Full payment shall be due upon receipt of each invoice on a prepayment basis even where any payment has not been made prior to accessing the copyright Internet access data. Service may be interrupted until such payment is made. All initial setup and ongoing service fees are to be paid as due when invoiced. Paid invoices are nonrefundable for any reason.
Initial Contract Activation
The above legal information and terms of agreement in relation to all the above is confirmed, agreed upon, and actualized by an order or request for services via email or letter, or applied payment to initiate Internet website building or to initiate access to any other Internet service offered by Canadian Financial Publishing Group. Upon activation, all setup fees and monthly access fees for one year and for subsequent renewal periods shall be due. This entire legal agreement of terms of use is openly and wholly accessible via direct links on your website.
Interruption of Service for Non-Payment
When service is interrupted for non-payment, an additional fee of $500 and an application of the current rates will apply upon reinstatement of services once the historic invoices are paid up to date. If for any reason the contractee deems to terminate an Internet service in relation to non-payment of a CFPG invoice an additional fee of $500 shall apply to remove the website from service at the discretion of CFPG. When services are halted or removed for continued non-payment, where any CFPG invoice is left unpaid, all rates shall be deemed to revert to the current rate and all invoices may be submitted to a collection agency. CFPG accounting will be the only record of reference to finalize any unpaid account.
Restrictions to URL Use
The Internet copyright content URLs can be set up on an individual website or corporate website insofar as no page served from the Internet websites of Canadian Financial Publishing Group is rearranged or copied. All URLs must be accessed from websites or servers owned or leased by Canadian Financial Publishing Group. No other server is allowed to serve the content offered by Canadian Financial Publishing Group unless payment for services has been rendered.
Website Readiness
Canadian Financial Publishing Group will not be responsible for premature advertisements or promotion by any client to anyone, by any method, who advertises their website as ready to view, until all configurations are proven to be working to the client's total satisfaction as it often takes more time than anticipated to configure a website for multiple reasons.
